“Responsibility of the surrogate under the Florida Health Care Surrogate Act”

A patient’s surrogate must:

  • Have the authority to act for patient in accordance to the patient’s instructions in his advance directive;
  • Consult with health care providers to provide informed consent;
  • Provide written consent whenever consent is required, including a physician’s order not to resuscitate;
  • Apply for public benefits, such as Medicare and Medicaid, for the patient; and
  • Authorize the release of information and medical records to ensure the continuity of the patient’s health care and may authorize the admission, discharge or transfer of the patient.
