“Confidentiality and privileged communications of psychological services under the regulation of professions and occupations law”

Any communication between any person licensed to offer psychological services and his or her patient must be confidential. This privilege may be waived when: the licensed person is a defendant to a civil, criminal, or disciplinary action commenced by the patient; the patient or the patient’s family agrees to the waiver in writing; or there is a clear and immediate probability of physical harm to the patient, or to other individuals and the licensed person communicates the information only to the potential victim, appropriate family member, or law enforcement authorities.
