“Civil enforcement of the law on nursing homes under the public health law”
(1) Any resident whose rights were violated may commence a lawsuit against a nursing home or a related facility. The lawsuit may be brought by the resident or his or her guardian, an organization acting on behalf of a resident, or a personal representative. Any resident who prevails in the lawsuit is entitled to recover the costs of the lawsuit and a reasonable attorney’s fee up to $25,000.
