“Unfair discrimination because of sex or marital status under the Department of Financial Services regulations”
A health insurer must not discriminate by refusing to issue a policy, canceling or declining to renewing a policy based on the sex or marital status of the applicant or enrollee. This regulation does not prohibit an insurer from taking marital status into account for the purpose of defining persons eligible for dependents’ benefits.
