“Advance directives under the Agency for Health Care Administration regulations”
Each home health agency must have written policies and procedures regarding advance directives. The policies must not condition treatment or admission upon whether or not the individual has executed or waived an advance directive. The home health agency must:
- In advance of receiving services, provide each adult patient with a copy of “Health Care Advance Directives- A Patient’s Right to Decide” which is prepared by the Agency for Health Care Administration.
- Provide each adult patient with written information concerning the home health agency’s policies regarding advance directives; and
- The requirement that documentation of whether or not the patient has executed an advance directive must be contained in the patient’s medical record.
