The opt-out requirements in Wis. Admin. Code §Ins. 25.17 do not apply when an insurer provides nonpublic personal financial information to any of the following:
- An unaffiliated third party to perform services for the insurer as long as the insurer provides notice and enters into an agreement with the third party that prohibits the third party from disclosing information other than what is needed in the ordinary course of business.
- An unaffiliated third party for marketing purposes under the brand name of the insurer, as long as the insurer provides notice, enters into an agreement with he third party that prevents the third party from disclosing information, the third party agrees to comply with the insurer’s standards, and the third party implements adequate safeguards to protect the security and confidentiality of the information.
