Hospitals and ambulatory surgical centers must implement a written policy protecting employees who disclose or report health information in good faith from retaliation, dismissal or harassment. Good faith reporting or disclosure includes information concerning alleged fraud or abuse within the facility or alleged violations of state or federal law, regarding patient safety or patient care. The law also requires hospitals and ambulatory surgery centers to identify a compliance officer, who must take specific action when allegations of fraud or abuse arise. The Department of Health and Senior Services must have access to the disclosed information.
