Emergency surgery or treatment-- Documentation of necessity
Permits providers to perform emergency medical procedures on patients receiving care at a mental health facility without a patient’s consent if the patient’s life is threatened and there is no time to obtain consent or the patient is incapacitated and a proper substitute (e.g., guardian, attorney-in-fact, etc.) consents. Requires providers to document the need for the medical procedure in the patient’s record.
