The Division of Elderly Services, within the Department of Social Services, must (1) ensure that Long-Term Care Ombudsman Program records are only disclosed as provided by the State Ombudsman or their designee; and (2) prohibit the disclosure of a resident’s identify without the resident or their representative’s consent or unless required by court order. Residents may consent in writing or orally. The record holding agency must document oral consent in writing.
