Health insurers that request or require an applicant to submit an HIV test must obtain the applicant’s prior written informed consent, reveal to the applicant how the HIV test results will be used and to whom the results may be disclosed; and provide the application with written information on HIV/AIDS approved by the Department of Health and Social Services.
An applicant may ask the person conducting the HIV test on behalf of the insurer any questions he or she may have regarding the HIV test and the informed consent.
