Health care providers may not disclose the identity of patients who took a HIV test or the results of the test in a manner, which permits identification of a patient. The information may be disclosed in limited circumstances. These include a third party who has an authorization to obtain the test results from the patient, disclosure pursuant to court order, and disclosure pursuant to oversight review organization monitoring programs such as the Child Death, Near Death and Still Birth Commission. These provisions do not interfere with the transmission of information as may be necessary to obtain third-party payment for medical care related to HIV infection or with the documentation of cause of death on death certificates.
