Del. Code Ann. tit. 16, § 4798 - The Delaware Prescription Monitoring Program
Health care professionals who prescribe controlled substances must report to the Office of Controlled Substances information on the patients who received controlled substance prescriptions and the type of prescription they received. A health care professional who fails to submit information as required under this statute may face disciplinary sanctions.
If a health care professional suspects that a patient is seeking a prescription of a controlled substance for reasons other than the treatment of an existing medical condition, the health care professional may obtain a patient utilization report regarding the patient for the past year from a computerized program established by the Office of Controlled Substances.
The Office of Controlled Substances must maintain procedures to ensure that the privacy and confidentiality of patient information collected. Any person who improperly discloses patient information or uses the information to commit other crimes is guilty of a felony and may face financial penalties and/or imprisonment.
