The Department of Health may take any steps necessary to protect the public health of the citizens of New Mexico, including imposing isolation or quarantine, or exclusion of an infected person from school or health facilities.  If an individual actively infected with a threatening communicable disease refuses treatment, the Department of Health may request a court order to detain the individual until they are no longer contagious.  The Department of Health may also issue orders requiring testing of those individuals at risk of transmission or exposure.  In order to carry out these functions, the Department of Health can have access to all medical records of an infected individual.  All notifiable condition reports must remain confidential and may not be disclosed unless authorized by law.
