Forms used by Insurance institutions, agents, and organizations to obtain authorization to disclose personal information must: (1) be written in plain language; (2) “is dated;” (3) identify the types of persons that may disclose personal information; (4) identifies the type of information that may be disclosed; (5) identifies the insurance institution, agent, or representatives to whom disclosure may be made; (6) identifies the purpose of collecting information; (7) specifies the duration of the authorization’s validity; and (8) notifies the individual that they may receive a copy of the authorization form.
Insurance institutions and third-party administrators (“Insurers”) must release health benefit information to the exclusive bargaining agent of employees covered through an employer sponsored plan upon the agent’s request and provide a copy of such information to the employer. Insurers may not include information about specific individuals when providing information to exclusive bargaining agents.
