Confidentiality of test - Me. Rev. Stat. tit. 5, § 19203

No person may disclose the results of an HIV test except to the following:

1. The subject of the test;
2. A health care provider designated by the subject of the test in writing;
3. An authorized person designated by the subject of the test in writing;
4. A health care provider who uses human body parts for donation purposes;
5. A research facility licensed by the Maine Department of Health and Human Services, or to a provider or blood bank for research purposes;
6. Other state agencies, including the Maine Department of Health and Human Services;
7. As part of a medical record;
8. Court ordered disclosure to a person who has been accidently exposed or to a victim of a sexual crime who has been exposed;
9. To a state health information exchange for the purposes of treatment, payment, or health care operations, that protects the disclosure of individually identifiable information.
