Persons that have knowledge of trade secrets, patient identities, or research subject identities because of their office may only disclose this information (1) to department employees that need the information to carry out their duties; (2) to persons specified by subpoena or court order; (3) to a government entity that regulates controlled substances; (4) to the central registry; and (5) to alert practitioners that their patient is already receiving a controlled substance from another practitioner.
Courts must ensure that confidential information discussed within a proceeding is not made public.
