All enrollee information regarding treatment or diagnosis held by a health maintenance organization (HMO) must be kept confidential. This information may only be disclosed with the enrollee’s consent, pursuant to a court order, or if there is litigation between the HMO and enrollee where the information is relevant. HMOs must also have separate procedures to ensure that enrollees’ mental health records are kept confidential.
