Information maintained in relation to physician, dentist, and podiatrist malpractice prevention programs, provider credentialing reviews, and adverse event reports is confidential. Only the department or hospitals complying with provider credentialing requirements may release such information.
New York’s freedom of information laws and civil practice disclosure laws may not be used to compel disclosure of information obtained, created, or discussed by committees engaged in patient safety or provider review activities required by the above statutes. Individuals may not testify about the proceedings of any committee in which they participate. However, statements by party to a proceeding or action to a committee are subject to discovery.
