All medical records of individuals receiving medical assistance, such as Medicare or Medicaid, must remain confidential and cannot be released without the written consent of the beneficiary or his representative. The medical record can be released for statistical or summary data purposes as long as it is de-identified. Information from the medical record may be exchanged between entities providing care, are fiscally responsible, or are state or local agencies.
