Insurers or other entities that deliver group health insurance must disclose utilization data, claims data, monthly premium information, and the number of insured individuals to a requesting employer. Insurers must remove identifying information, in accordance with HIPAA regulations, before disclosing the information.

Employers may only use the information from their insurer to obtain group health insurance quotes or promote employee wellness initiatives.

Information disclosed to employers is exempt from Connecticut’s Freedom of Information Act.  Employers that receive a subpoena to release insurance information in relation to a judicial proceeding must notify their insurer. The insurer may subsequently file a motion to squash the subpoena.
