Civil action for false claims-N.M. Stat. Ann. § 27-14-7

If the Department determines an individual violated the Medicaid False Claims Act, the Department may bring a civil action against the individual. Any affected individual may also bring a private action against an individual violating the Medicaid False Claims Act and may do so on behalf of the state. However, the affected individual must first serve the Department with the complaint and all material evidence. Such information will remain under seal for 60 days while the Department conducts an investigation. Following the investigation, if the Department finds the evidence supports the allegations, the defendant may be served with the complaint. The attorney general must be notified and must agree in writing to the submission of the case in court.
