Alaska Stat. § 28.35.030(d) - Operating a vehicle, aircraft or watercraft while under the influence of an alcoholic beverage, inhalant, or controlled substance

This subsection is referenced in the statute governing the confidentiality of substance abuse treatment records as providing an exception to the general confidentiality provision. It requires treatment programs treating patients who are ordered to treatment because they were convicted of driving under the influence to provide information to the judge, prosecutor, and defendant regarding the patient’s treatment progress. This information may be used in proceedings involving the defendant’s treatment, including in sentencing proceedings for driving under the influence.
