Pre-admission certification committees must approve the transfer or admission of children and youth to a residential treatment facility. Such committees may review clinical records in order to ascertain whether an individual’s admission or transfer to a residential treatment facility is appropriate. All clinical records and assessments obtained by committees are confidential. The commissioner may, however, access these materials in order to assess the committee’s performance.
Clinical records of residential treatment facility residents must be kept confidential as provided by § 33.13.
