Access to linking database-N.M. Code R. § 7.1.20.13

State and federal agencies may link their databases to the relevant databases within the HIS, but only to the extent that the data linked is relevant to the agency’s purpose. If the linked databases create a linked file, the parties that contributed to it jointly own the linked file. All linked databases are governed by a governing agreement, the Health Information System Act, and this rule. Such a governing agreement must contain confidentiality and use requirements. If a governing agreement relates to Medicaid data, the data received must be protected against disclosure of Medicaid recipient identifier information. All information in linked databases must be de-identified.
