Skilled and intermediate care nursing facilities must maintain clinical records for each resident. Clinical records must be contain residents’ personal information, medical history, and any existing advance directives. Records must be retained for 6 years after a resident’s discharge or, in the case of a minor, 3 years after reaching adulthood.
Residents’ patient information must be kept confidential pursuant to the federal Health Insurance Portability and Accountability Act and DEL. CODE tit. 16, § 1121.
Skilled and intermediate care nursing facilities that have electronic medical records must maintain safeguards to prevent unauthorized access and alteration of records.
