105. Mass. Code Regs. 301.040. - Confidentiality of Reports

The Department of Public Health must maintain the confidentiality of the reports sent to the Cancer Registry. The Department cannot release any reports that contain patient identifying information. A report may be released to the particular individual in the report upon a signed, written request or with appropriate identification. If the individual is a minor, a signed written request by the parent, a copy of the birth certificate, and identification by the parent is needed. The rule also identifies when reports may be released to legal guardians, attorneys, or others. The Department can release information to the representative of a study or research project, but may not release social security information. The patient’s name or other patient identifying information cannot be used in the study.
