“Hearing Process for Nurse Aides, Home Health Aides and Homemakers”
This section establishes the hearing process available for an accused nurse aide, home health aide or homemaker. This hearing must be completed within 120 days from the day it receives the request for a hearing.
After the adjudication of a case, the hearing officer shall transmit a copy of the decision to the accused nurse aide, home health aide or homemaker and to the Department. The Department must also send a copy of the hearing officer's decision to the administrator of the facility, the Attorney General, and the registry. If the decision rendered by the hearing officer is adverse to the accused nurse aide, home health aide or homemaker, the hearing officer shall also transmit to such individual a notice informing him or her of the right of appeal.
