MYTH: HIPAA Limits the Use and Disclosure of Information in Student Medical Records.

FACT: The Family Educational Rights and Privacy Act (FERPA) governs the use and disclosure of student health records.

The Family Educational Rights and Privacy Act (FERPA) protects the privacy of student education records maintained by education agencies and institutions that receive federal funding. Education agencies and institutions may only release education records upon obtaining the written consent of a parent or guardian or a student over the age of 18. However, there are a number of circumstances in which disclosures may be made without written consent.
