Legal ownership of health information is a complex issue, distinct from rights to access or copy information.  New forms of medical records, such as EHRs and PHRs, and new tools that collect health information, such as personal health trackers and medical monitoring devices, further complicate the landscape. We have drafted a Fast Facts and a Myth Buster to help clarify the issue of health information ownership.  We have also revised and updated our map of state medical record ownership laws.
