State Status on Health Insurance Marketplaces (as of 2013): 50 State Comparison


This map shows the status of the state action on the health insurance marketplaces or exchanges, established under the Patient Protection and Affordable Care Act.  The map defines those states that are establishing their own exchanges as State-Based Marketplaces.  State-Partnership Marketplaces are defined as states that are working with the federal government to set up the Marketplaces in their states, but retain plan management and consumer assistance functions.  A majority of states have opted to establish Federally-Facilitated Marketplaces, which are set up and run by the federal government.  Additional information and original research that contributed to this map can be found here:  "State Action to Establish Health Insurance Marketplaces."

New HampshireState-Federal Partnership Marketplace (State conducts plan management and consumer assistance)
N.H. Rev. Stat. § 420:N-7The law prohibits any state agency or entity in the state of New Hampshire from creating or participating in a state-based health insurance exchange.  However, state agencies may interact with the federal government to create a federally-facilitated exchange for the state
 
N.H. Rev. Stat. § 420:N-8:  The law requires that if a federally-facilitated exchange is established in New Hampshire, that the Insurance Commissioner retain its authority, including licensing of producers/carriers, rate approval, reinsurance, network adequacy, grievance standards, and unfair trade practices, for products sold on the exchange.

U.C.A. § 63M-1-2504Utah has created an Office of Consumer Health Services within the Governor’s Office of Economic Development, which has created a Health Insurance Exchange for small businesses, which the state regulates.  The federal government will establish and run the individual marketplace in the state.

33 V.S.A. § 1803The Department of Vermont Access must establish the Vermont Health Benefit Exchange, to be administered by the Department and an advisory committee.

R.C.W. § 43.71.020Establishes the Washington Health Benefit Exchange as a public-private partnership, separate and distinct from the state.

West VirginiaState-Federal Partnership Marketplace (State conducts plan management and consumer assistance)

W. Va. Code § 33-16G-3:  Establishes the West Virginia Health Benefit Exchange within the Office of the Insurance Commissioner, as a state entity.  The Exchange must obtain federal funding and be recognized as an exchange under the federal law.
